GENERAL TERMS AND CONDITIONS

1- General terms and conditions

The present general terms and conditions of sale apply strictly to all sales of products made in Spain, including the Canary and Balearic Islands and Portugal as well as Europe by AVEKITS. Any order made to AVEKITS, necessarily implies as an essential, determining and indispensable condition, the unreserved acceptance by the Customer of the General Conditions of Sale in force on the day the corresponding order is placed. Furthermore, the Client recognizes that the acceptance of the present conditions will imply their application to the order to which they refer, as well as to any subsequent order, with the exception of those cases in which new conditions are brought to his knowledge by AVEKITS. The fact that AVEKITS does not have recourse to any of the present conditions at any given time shall not be interpreted nor shall it be equivalent to waiving recourse to them in the future or in the past. Applicable law and competent jurisdiction. The interpretation and execution of the conditions, as well as all acts that are a consequence of them, will be subject to Spanish law, unless there are provisions of public order contrary to it.

2- Prices

The prices published in AVEKITS are in Euros, and are valid except for typographical errors. All prices include the VAT applicable on the day of the order, any change of VAT rate will be automatically applied to the prices of the products on sale in AVEKITS. Offers on products on sale at AVEKITS will be shown in the "Offers" section or indicated on the product card and, if not otherwise indicated, will be valid as long as they are shown on the screen.

3- Different payment methods

When placing the order, the customer can freely choose to pay for the purchases made in AVEKITS by means of: bank transfer or deposit in account, as well as Credit/Debit Card (VISA, MASTERCARD, MAESTRO) through the secure payment gateway of our bank, as a novelty the payment option with Bizum may also be used by the same payment gateway of our bank.

4- Product

The offers presented by AVEKITS are valid within the limit of available stock. AVEKITS reserves the right to modify the assortment of products according to the constraints imposed by its suppliers. The photographs, graphics and descriptions of the products offered for sale are only indicative and do not commit the seller in any way.

Please note that we are manufacturers and many of our models in kits, may be available for immediate delivery and other models will be manufactured once you place the order, so the delivery time for the latter option will be longer, thus informing in the product details.

5- Shipping

The purchased products will be delivered to the person and address indicated in the order. On Saturdays, Sundays and holidays there will be no delivery. However, delays will not imply either cancellation of the order or any compensation. An order is considered delivered when the carrier delivers the package(s) to the customer and the customer signs the delivery receipt document. It is the customer's responsibility to check the condition of the goods upon receipt and to communicate any anomalies to AVEKITS. As a general rule, the packages will be sent on the same day the order is received as long as the order is placed before 15:00 and the kit or parts to be manufactured are in stock with immediate availability, if the order is placed after 15:00 the shipment will be sent the next working day as long as the item is in stock and with immediate availability, otherwise the approximate production time will be specified in the details of the product.

Shipments will be made through the transport agency TIPSA 24/48h service as long as the destination is in mainland Spain.

For shipments to Canary Islands, Balearic Islands please contact us and we will try to find the most interesting shipping service for you.

International shipments will be sent by post, you will be informed in advance of the type of service and its total cost.

At the customer's request, the shipment can be sent by international agencies such as DHL, UPS, GLS, etc. You will be informed in advance of the service and its costs.

6- Return and cancellation policies

6-1 Return of merchandise: Our policy, in compliance with current regulations, is to grant you the right to return any item purchased at AVEKITS within 14 days from the date of receipt. You will not have to provide any explanation, any item, purchased in AVEKITS, returned in its original packaging, sealed and in perfect condition will be accepted without further ado. (Remember that the raw material of our models is wood and as a natural material it can undergo changes affecting the environmental conditions, such as humidity, air, light etc, so we recommend that in case of a return you do it in the shortest possible time to improve the conservation of the kit). Once the product is received in our warehouse and after checking its condition, we will proceed to refund the amount through the payment method used in the purchase, within a maximum period of 14 days after the notice of withdrawal. If the reason for the return is that the returned article is defective or does not correspond to what was requested in the order, AVEKITS will bear the return and new shipment costs. If the reason for the return is that the order does not satisfy you, we will reimburse the amount but not the return costs incurred. 6-2 Cancellation of order: If the cancellation of the order arrives before the departure of the goods the customer will not have any cost. In the case of a cancellation after the order has been dispatched, the customer will have to pay the cost of returning the order.

7- Product warranties

AVEKITS guarantees the products it sells against manufacturing defects. The Customer must take into account, when reporting a defective product, that for the correct operation of the products it is essential to know them perfectly and to have carefully read our warnings, drawings, user and safety manuals. In particular, it must be taken into account that any blow or shock received by the product as a result of the use for which it is intended may cause internal problems not detectable to the naked eye. The Customer must check, before using the product, that the different parts that make up the product are in perfect condition and, if not, contact AVEKITS as soon as possible to proceed to solve the problem. The warranty does not cover: Defects caused by misuse or accident, as well as wear and tear due to normal use or damage caused by maintenance of the kit. Defects related to exceeding the limitations given by the product specifications. Procedure for repair or replacement of a product under warranty: In relation to incidents due to damage caused by transport: the Customer must check the condition of the package received and, if he/she detects any anomaly in it, state it on the delivery note provided by the transport agency or post office before signing it. This step is essential in order to be able to make an insurance claim in case of damage caused by the transport. Failure to do so will result in the Client waiving any possible claim in this respect. The Client will communicate to AVEKITS any mishap of this type, in order to be able to undertake the opportune negotiations with the transport agency, as well as to proceed to the replacement of the damaged product or of the individual pieces involved when this is possible. If upon receiving the order, the Client verifies that what he/she received does not coincide with what he/she bought, or that any product or any part is missing, he/she must communicate it as soon as possible, and always before 2 working days, together with the order number. AVEKITS will proceed to solve the problem at no cost to the customer. If upon receiving the order, the Client verifies that some product does not work, after having verified that he/she knows its operation, assembly, construction, adjustments, he/she must communicate it to AVEKITS before 15 days. AVEKITS will remove the product at no cost to the customer. Once the pertinent verifications have been made, AVEKITS will replace it with a new one, or it will proceed to refund the amount, including shipping costs, in case the same product is not available. If after those 15 days a failure related to a manufacturing defect arises, the Customer must contact AVEKITS to receive instructions on how to proceed.

In any of the previous cases, if after the corresponding verifications it is observed that the product does not contain defects covered by the described assumptions, the product will be returned to the customer, who will assume the costs of the return of the product.
